WHO WE ARE

This policy explains what we do with your personal information when you shop with us, sign up to hear from us, or use sergedenimes.com.

Serge DeNimes is a trading name of Serge D Limited, a company registered in England and Wales under number 16642191, with its registered office at Kovacs House, 57D Hatton Garden, London EC1N 8JD. We are the data controller for the information described here, and we are registered with the Information Commissioner's Office under registration number C1876735.

WHAT WE COLLECT

We collect information you give us, and information we gather automatically as you use the site.

Information you give us:

• Your name, email address, delivery and billing addresses and phone number when you place an order or create an account
• Payment details, which are taken and processed by our payment providers rather than stored by us
• Your email address when you sign up to our mailing list
• Anything you tell us when you contact us about an order, a return or a repair
• Any review or rating you choose to leave

Information we collect automatically:

• Your IP address, device type, browser and operating system
• Which pages you view, what you search for and what you add to your basket
• How you arrived at the site, and whether you have visited before

We collect this through cookies and similar technologies. See Cookies below.

We do not ask for special category information — for example your health, religion or ethnicity — and you should not send it to us.

HOW WE USE IT

Under data protection law we have to have a lawful reason for using your information. Ours are set out below.

To take and fulfil your order — processing payment, arranging delivery, dealing with returns, exchanges and repairs, and answering your questions. We need this to perform our contract with you.

To run and improve the site — keeping it secure, understanding how it is used, fixing what does not work and making it better. This is in our legitimate interests in running a business well.

To send you marketing — emails about new pieces, restocks and offers, where you have signed up or where you have bought from us and we are telling you about similar products. You can unsubscribe at any time using the link in any email, or by emailing us. We rely on your consent, or on our legitimate interest in marketing to existing customers.

To invite you to review your order — through Feefo, our independent reviews provider. This is in our legitimate interests in understanding what customers think of our products and service.

To prevent fraud and keep accounts — checking orders for fraud, keeping records for tax and accounting, and dealing with any dispute or legal claim. We do this to comply with our legal obligations and in our legitimate interests in protecting the business.

WHO WE SHARE IT WITH

We do not sell your personal information. We do share it with the companies that help us run the business, and each of them may only use it to provide their service to us.

• Shopify, which hosts our online store
• Shopify Payments, PayPal, Shop Pay and Google Pay, which take your payment
• Swap Commerce, which handles pricing, duties and taxes on international orders
• Royal Mail, DPD and FedEx, which deliver it
• Our returns portal provider, which issues return labels and tracks returns
• Klaviyo, which sends our emails
• Gorgias, which runs our customer service inbox and Help Centre
• Feefo, which collects and publishes reviews

We may also share information with our professional advisers, and with the police, regulators or other authorities where we are required to by law. If the business is ever sold or reorganised, customer information may transfer to the new owner.

COOKIES

We use cookies and similar technologies to keep the site working, remember your basket, understand how the site is used and show you relevant advertising. You can manage your preferences at any time through the cookie settings on the site, and through your browser.

SENDING INFORMATION OUTSIDE THE UK

Some of the companies we work with are based outside the United Kingdom, or store information on servers outside it. Where your information is transferred outside the UK, we make sure it is protected to the same standard — either because the country has been recognised by the UK government as providing adequate protection, or by putting approved contract terms in place with the company concerned.

HOW LONG WE KEEP IT

We keep your information only for as long as we need it.

• Order and transaction records are kept for seven years, which is the period we are required to keep them for tax purposes
• Account details are kept while your account is open, and for a period afterwards in case you come back
• Marketing information is kept until you unsubscribe, and for a short period afterwards so we can honour your request
• Customer service correspondence is kept for up to three years

When we no longer need your information, we delete it or anonymise it so it can no longer be linked to you.

YOUR RIGHTS

You have the right to:

• Ask for a copy of the personal information we hold about you
• Ask us to correct anything that is wrong or incomplete
• Ask us to delete your information, where we no longer need it
• Ask us to restrict how we use it, or object to us using it, including for marketing
• Ask us to send your information to another provider, where it is technically possible
• Withdraw your consent at any time, where we rely on consent

To exercise any of these, email orders@sergedenimes.com. We will respond within one month. There is no charge, and we may ask you to confirm your identity first so we do not give your information to somebody else.

KEEPING YOUR INFORMATION SAFE

We take appropriate technical and organisational measures to protect your information, and we work with established providers who do the same. No transmission over the internet is completely secure, but we take security seriously and will tell you and the regulator if anything goes wrong where we are required to.

CHILDREN

Our site is not aimed at children, and we do not knowingly collect information from anyone under 16. If you think a child has given us their information, email us and we will delete it.

COMPLAINTS

If you are unhappy with how we have handled your information, please tell us first at orders@sergedenimes.com and we will do our best to put it right.

You also have the right to complain to the Information Commissioner's Office, the UK regulator for data protection, at ico.org.uk or on 0303 123 1113.

CHANGES TO THIS POLICY

We may update this policy from time to time, to reflect changes to how we work or to the law. The date at the top shows when it was last changed. Please check back from time to time.
